Understanding Separate Property
Hi there, this is Jay Bills, Okmulgee Attorney, and I’m here today to talk to you about, in a divorce case, what’s separate property? Some of the properties were acquired during the marriage, and some of the properties were not. Do you have an inherited property that you want to know whether or not that’s marital property or not?
There are certain things that you can do during the marriage that turn separate inherited property into a marital asset, so you have to be careful about how you handle gifts from family or inheritance to make sure you don’t combine that into the marriage. Or if you’re a spouse who, your other spouse has inherited property and they’ve taken that money and invested it into the marital home, maybe you have a right to some of that now.
